EU Settlement Scheme (EUSS)

The EU Settlement Scheme was introduced following the UK’s exit from the European Union. It allows EU, EEA, and Swiss citizens—along with their eligible family members—who were living in the UK by 31 December 2020 to secure their legal status and continue life in the UK.

Through the scheme, you can obtain either Pre-settled Status (temporary) or Settled Status (permanent), ensuring your rights to live, work, and study are protected.

The scheme was created after Brexit for EU, EEA, and Swiss citizens (and their eligible family members) who were living in the UK by 31 December 2020.
It grants either pre-settled status (temporary) or settled status (permanent).
 

Pre-settled Status

Given to people who had lived in the UK for less than 5 years when they applied.
Rights: you can live, work, study, access the NHS, and claim certain benefits.
Used to expire after 5 years, but now:
   ➤ Pre-settled status is automatically extended for 5 years before it runs out (so you won’t suddenly lose your rights).
   ➤ Expiry dates are no longer shown to employers or landlords, to reduce discrimination.
Absences: before, being outside the UK for more than 2 years caused the status to lapse. Now, the rules changed in May 2024 — status lapses only after 5 years of continuous absence.
 

Settled Status

Normally requires 5 years of continuous residence in the UK.
But from July 2025, there is a new rule: if you can show at least 30 months (2.5 years) of residence in the UK during the past 60 months (5 years), you can qualify for settled status. This makes it easier for people with breaks in residence.
Once granted, settled status is permanent (like Indefinite Leave to Remain).
You keep your rights to live, work, access services, and travel in and out of the UK.
After holding settled status for 12 months, you may be able to apply for British citizenship if you meet other requirements.
